Terms and Conditions of Affiliation

Article 1: Contract - Scope of application

The present General Terms and Conditions of Affiliation (hereinafter referred to as "GTC") govern the commercial relationship between the website www.huiles-et-sens.com, owned by ALGOVITAL SARL, 156 La Venue de Mazan, 84330 Saint Pierre de Vassols, France (hereinafter referred to as "the Affiliate"), and the commercial partner (hereinafter referred to as "the Affiliate").

The Affiliate offers an affiliation program enabling the Affiliate to create links between its site and that of the Affiliate. These links enable Internet users to access the Affiliate's site and purchase products. The Affiliate is remunerated by the Affiliate on the basis of a commission for sales made via these links.

The Affiliate may use several affiliation links on its site, which must be accessible by search engines. Content must be related to essential oils and aromatherapy. Any non-conforming conditions will be rejected, unless prior written agreement has been obtained.

The Affiliate may modify these terms and conditions at any time, by informing the Affiliate by e-mail and publishing the modifications on the www.huiles-et-sens.com. website. The Affiliate reserves the right to reject any partnership request at its discretion, without justification.

Article 2: Affiliate status

To be eligible, the Affiliate must have a quality website, blog or Facebook page focusing on essential oils, aromatherapy and cosmetics. The Affiliate reserves the right to accept or refuse Affiliate status.

Article 3 : Remuneration - Amount of commission

The commission is set at 20% of sales excluding taxes. Purchases made by the Affiliate itself are not remunerated. Commissions are calculated on the basis of the first sale made by a customer who clicks on an affiliate link. Diffusers, books, perfumes and workshops are excluded from the program.

Article 4 : Firm sales

Sales are considered firm after a period of fourteen days following delivery of the products, in accordance with the Affiliate's return policy.

Article 5: Payment of Commissions

Affiliates may request payment of their commissions as soon as they reach a minimum amount of 50 euros, via the option provided in their affiliate account. Payments will be made by cheque or bank transfer, with any exchange charges borne by the Affiliate.

Article 6: Technical means - Fraud

The Affiliate acknowledges the Affiliator's ability to evaluate sales and calculate commissions. Any attempt at fraud will result in immediate closure of the Affiliate's account and non-payment of all sums due. Statistics will be available in real time on the Affiliate's website.

Article 7: Contract duration - Termination

The contract is concluded for a period of one year, tacitly renewable. Either party may terminate the contract at any time by e-mail with acknowledgement of receipt, without compensation.

Article 8 : Reservation of ownership

All elements supplied remain the property of the Affiliate. The Affiliate's contact details and customer information remain the exclusive property of the Affiliate.

Article 9: Site modification

Any change to the site (name, hosting, etc.) will not affect the affiliation contract, which will automatically apply to new versions of the site.

Article 10: Protection of Personal Data

The Affiliate's personal data is used to manage the affiliation, in accordance with the law on data protection. The Affiliate may access, rectify or refuse the use of his/her data by contacting the Affiliate. By accepting these GTC, the Affiliate consents to the collection and use of his/her personal data.

Article 11 : Liability

The Affiliate shall not be liable for interruptions in service, force majeure or other events beyond its control. Nor shall it be liable to compensate the Affiliate for any loss of business or profits.

Article 12: Applicable Law and Jurisdiction

These General Terms and Conditions are governed by French law. In the event of a dispute, the French courts shall have jurisdiction, and the Tribunal de Commerce d'Avignon shall have exclusive jurisdiction.
